Washline terms of use

1. Who and what

These terms apply to your use of the game Washline (in the Netherlands: Waslijn, "the game") by Toob (sole proprietorship, operated by Tobias Hesselink, based in the Netherlands, KvK 88227677, VAT ID NL004565523B51) ("we"). By installing or using the game you agree to these terms. If you do not agree, do not use the game.

Downloads through the App Store or Google Play are also subject to the terms of Apple (Licensed Application End User License Agreement) or Google. In case of conflict, those of Apple or Google prevail as far as their services are concerned. Apple and Google are not a party to these terms and are not responsible for the game or its support.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the game on your own devices for personal, non-commercial use. The game is licensed, not sold.

3. Age

The game is intended for players aged 13 and over. If you are under 18, use the game and make purchases only with the permission of your parent or guardian. If your device indicates you are under 16, the game limits advertising and measurement as described in our privacy policy. If you use the game on behalf of a child, you are responsible for the use and purchases.

4. Virtual items

Coins, lives, boosters and other items in the game are part of the licence. They have no cash value, cannot be exchanged for money or transferred to others, and you have no ownership of them. Your progress is stored locally on your device and, if iCloud is available, also kept in your own iCloud account so it can follow you to a new device. "Delete data" also removes that iCloud copy. If you uninstall the app, use "Delete data", lose your device or do not use iCloud, progress and a stock of coins or boosters may be lost. We cannot restore them. One-time purchases such as "Remove ads" can be restored through Restore purchases.

Achievements and leaderboards use Apple Game Center if you are signed in; Apple's terms apply to Game Center.

We may change prices, quantities, rewards and game rules for future purchases and future content, for example for game balance. We will not reduce the value or amount of virtual items you have already bought, and we will not change what a purchase delivers after you bought it, except where the law requires it or the item is withdrawn for security reasons. Before every purchase you see exactly what you get, including quantity, price including VAT and (for time-limited items) the duration. The game contains no paid random rewards.

Personalised offers. Some special offers are shown based on how you play (such as levels played, earlier purchases, or whether you watch ads). This happens on your device. The price of every product in the shop is the same for everyone in your country.

5. Purchases and payment

• Purchases in the game go through the App Store or Google Play. Prices are shown by the store, including VAT.
• Payment, invoicing, refunds and withdrawal are handled according to the rules of Apple or Google. If you want a refund, request it from Apple or Google.
• For digital content delivered immediately after you confirm the purchase, you can lose your statutory right of withdrawal once delivery has started, if you have expressly agreed to immediate delivery and acknowledged that you thereby lose that right. The store shows you this choice before you pay. If you do not agree, do not complete the purchase. This does not affect your other statutory rights, such as for a product that does not conform to the contract.
• Season passes and other time-limited items apply for the stated period or season.

6. Advertising

The game shows ads served by Google AdMob. Optional rewarded ads let you choose to get extra help. The ads between levels can be removed with a purchase; rewarded ads then remain available. We are not responsible for the content of ads or for websites and apps they link to. How we handle your data is described in our privacy policy.

7. Acceptable use

You may not: interfere with the game or third-party servers; decompile, modify or copy the app, except to the extent mandatory law allows; cheat using tools, bots or modified versions; exploit the game or parts of it commercially; or infringe the rights of others. In case of misuse we may restrict or end your access.

8. Availability and updates

The game can be played offline, but ads, the shop and some features need an internet connection. We may update, change or discontinue the game, for example for technical or business reasons. We will do our best to let you know in good time if we discontinue the game. Purchased items cannot then be refunded unless the law requires it.

9. Intellectual property

All rights in the game, including software, design, visuals, sound and names, belong to Toob or its licensors. You only receive the right of use in section 2.

10. Liability

The game is provided as is, without a guarantee that it works uninterrupted or error-free. Statutory rights you have as a consumer, for example for a product that does not conform to the contract, remain fully in force. Our liability is limited to direct damage and to the amount you paid us in the 12 months before the event causing the damage, unless there is intent or deliberate recklessness, or the law does not allow a limitation. We are not liable for loss of local game progress.

11. Changes

We may change these terms. The current version is on this page with its date at the top. If you use the game after a change, that counts as acceptance to the extent the law allows. For major changes we will tell you in the app.

12. Governing law

These terms are governed by Dutch law. As a consumer you keep the mandatory protection of the law of the country where you live. Disputes are submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.
